DIY Toolshare – Terms of Service

These Terms of Use (the “Terms”) apply to your use of the DIY Toolshare platform (website, mobile application and related services) (the “Platform”). By creating an account, listing a Tool, requesting a Booking, posting content, or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. Marketplace role (peer‑to‑peer)
1.1 The Platform is a peer‑to‑peer (P2P) marketplace. Tools are listed by users and rented between users under a separate rental contract (the “Per‑Rental Contract”). DIY Toolshare is not the owner, manufacturer, importer, distributor, or supplier of Tools and is not a party to the Per‑Rental Contract, except as a platform service provider.
1.2 We do not provide training, engineering inspection, or safety certification, and we do not PAT (Portable Appliance Testing) test Tools. Users must check safety and suitability before use.
2. Contract formation (when a Booking becomes a contract)
2.1 A Borrower’s booking request is an offer to rent. A Binding Per‑Rental Contract forms: (a) when a Lender accepts the request; or (b) for instant‑book Listings, when the Platform issues a booking confirmation screen/email. The parties to the Per‑Rental Contract are the Lender (tool owner) and the Borrower; DIY Toolshare is not a party.
2.2 We may facilitate communications, deposits, and payments as agent for the Lender for the limited purpose of collecting amounts due under the Per‑Rental Contract.
3. Fees, deposits, and payments
3.1 Platform fee: We charge a 20% commission (minimum £0.50) on the rental price shown at checkout. Our commission is subject to VAT (Value Added Tax) where applicable.
3.2 Payment timing: The Borrower’s payment method is authorised at booking. We collect payment at the start of the Rental Period (or as shown at checkout) and may hold a deposit as a pre‑authorisation.
3.3 Payouts: Net amounts (rental price less our commission, taxes and any adjustments) are released to the Lender after the Rental Period completes and no issues are reported, usually within 3–5 business days via our payments provider (e.g., Stripe).
3.4 Adjustments: Late fees, loss/damage amounts and agreed changes may be charged to the Borrower and set‑off against deposits or future payouts in line with the Per‑Rental Contract and our processes.
3.5 Chargebacks: If a payment is reversed, we may pause payouts and recover sums owed from deposits or future earnings.
3.6 Currency & rounding: All amounts are in GBP (Great British Pound). Minor rounding may apply.
3A. On‑platform payments and anti‑circumvention
All rentals and related charges must be processed through the Platform. You must not circumvent the Platform’s payment system or our fees (for example, by arranging to pay or be paid off‑platform). We may suspend or terminate accounts that breach this rule.
3B. Tax and VAT (Value Added Tax) responsibilities
Lenders are responsible for determining and meeting any tax obligations on income earned through the Platform, including reporting to HMRC (His Majesty’s Revenue and Customs) where required. In the UK, the £1,000 trading allowance may apply; if your total income from such activities exceeds this, you must declare it via Self‑Assessment. We do not provide tax advice and do not withhold or remit tax on your behalf. Our commission is subject to VAT where applicable; any VAT on rentals (if due) is the Lender’s responsibility.
4. Cancellations, cooling‑off and time‑specific services
4.1 Consumer Contracts Regulations 2013 may provide a 14‑day cancellation right for certain online contracts. However, time‑specific bookings for dated services may be exempt. Where you ask us to begin services within the cancellation period, you acknowledge you may lose the right to cancel once the service is fully performed.
4.2 Cancellation rules for Bookings are shown at checkout and/or in the Listing and will prevail.
5. Listings and prohibited items
5.1 Lenders must list Tools accurately and only list items they have the legal right to rent out.
5.2 Prohibited/restricted items include (non‑exhaustive): gas equipment requiring certification, recalled items, medical devices, weapons, petrol‑powered machinery without appropriate safety controls, high‑risk access equipment beyond domestic use, and any item prohibited by law or our policies. We may remove Listings at our discretion.
6. Safety and competence
6.1 Borrowers must be 18+ and competent to use the Tool safely, follow manufacturer instructions, and use PPE (Personal Protective Equipment).
6.2 Electrical safety and the PAT (Portable Appliance Testing) gap: We do not PAT test Tools. Borrowers must inspect before use and must not use Tools that appear unsafe. Avoid using corded Tools in wet environments.
7. Identity checks and badges
7.1 We may require identity and/or address verification (e.g., Stripe Identity). A “Verified” badge indicates a completed check at a point in time; it is not an endorsement or guarantee.
8. Content and conduct
8.1 You remain responsible for Content you upload. Do not post unlawful, infringing, or deceptive Content. We may remove Content and/or suspend accounts where reasonably necessary.
8.2 Anti‑scraping: You must not conduct text/data mining or web scraping, including for training, fine‑tuning, or validating Artificial Intelligence systems, except where such restrictions cannot be excluded by law.
9. Protection (platform‑arranged) - if offered
9.1 Where stated at checkout, we may arrange platform‑funded Protection for the Tool during the Rental Period, subject to the stated limit and exclusions. Protection applies to the Tool only and is not public or product liability insurance. Theft requires a police crime reference number.
9.2 Any third‑party insurance (if offered) will be between the named insured(s) and the insurer. DIY Toolshare acts as a technology/intermediary to pass declarations and is not an insurer or insurance intermediary.
10. Disputes and enforcement
10.1 Users must first try to resolve issues via Booking chat. We may assist but are not obliged to resolve disputes. We may suspend accounts, remove Listings, withhold payouts, or cancel Bookings where we reasonably believe there is risk of harm, fraud, or legal non‑compliance.
11. Limitation of liability
11.1 Nothing limits/excludes liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded.
11.2 Subject to 11.1, we exclude implied conditions/warranties to the extent permitted by law and are not liable for indirect or consequential losses (including loss of profit/opportunity).
11.3 Subject to 11.1, our total liability arising out of or in connection with the Platform is limited to the greater of (a) the total Fees paid by you to us in the 12 months before the event and (b) GBP 100. Consumer statutory rights are unaffected.
12. Privacy and data
12.1 We process personal data per our Privacy Policy and UK‑GDPR (United Kingdom General Data Protection Regulation). We use privacy‑friendly analytics and do not sell personal data.
13. Territory and general
13.1 Territory: DIY Toolshare currently operates in the United Kingdom only. You must not use the Platform where doing so would be unlawful in your location.
13.2 Governing law: England and Wales; courts of England and Wales (subject to mandatory consumer protections).
13.3 We may update these Terms; we will post the updated version with an effective date.
13.4 If any clause is found unlawful, the remainder remains in effect.
